Almost twenty years after their split, it looks like Alex Van Halen and his ex-wife are heading to court.
Following the couple’s divorce in 1996, Kelly Van Halen opted to keep her ex-husband's surname. Now, she is launching a self-named interior design/construction company, and Van Halen has taken issue with it.
According to The Hollywood Reporter, the band, which is of course named for brothers Eddie and Alex Van Halen, has an intellectual property holding company called ELVH Inc. After Kelly reportedly filed two trademark applications under the name “Kelly Van Halen” in order to sell products such as “chairs, children's blankets and bathing suits” as well as “building construction and interior design services,” ELVH moved to take Kelly to federal court for apparent trademark infringement.
The lawsuit reportedly states that the name of Kelly’s company is “confusingly similar” to that of the band’s name, and also stresses that that products that the defendant is attempting to sell “are either identical or closely related to the goods sold by Plaintiff.”
Further, the lawsuit alleges that Kelly Van Halen is basically trying to "pass off" the Van Halen name, which would cause “unfair competition” for the band.
